Abstract
Over the past six decades, feminist activists, scholars and legislators have achieved many reforms in sexual assault (SA) law within the U.S. While these reforms expanded legal recognition for SA, many barriers remain for people who experience SA when entering the legal system. Although scholars have acknowledged these barriers, the role of time in the legal response to sexual violence remains underexplored. This thesis examines the relationship between legal temporalities and SA law with a focus on entering the legal system. Using the frameworks of Critical Legal Studies, Feminist Legal Theory and legal temporalities, I argue that time is not a neutral factor and is used to deny credibility or entry into the legal system for people who experienced SA. To convey this argument I provide an analysis of timely disclosure, the role of time in the ideal victim framework and fact construction. Ultimately, this thesis adds to the urgency of revisioning justice in another place than, and through other approaches provided by, the legal system.
