Abstract

As artificial intelligence (AI) technologies and uses have grown over the past years, so has the need for AI policies. The European Union (EU) has created the EU AI Act (AI Act): a risk-based legal framework on AI, applicable to AI developers and users within the EU. This study examines how Dutch municipalities can frame their AI policies to align with the AI Act. This is done by combining a literature review and a document analysis on existing Dutch municipal AI policy. Ten municipal documents and one national document were analysed using deductive coding based on the literature review, and iterative coding based on the examined documents. Results show that policies differ by level of detail and that GDPR compliance is more emphasized than AI Act compliance. Further emphasis on the risk-based approach by the EU in municipal AI policies and clearer documentation and reporting strategies allow municipalities to adapt the AI Act into their own policies. Cooperation between municipalities allows every municipality to use policies used by different municipalities and suit them to their own needs.
